Condor often involuntarily downgrades passengers cabin class from Business to Coach. In that case Condor must refund you 75% of your total cost. Per European Commission Regulation No. 261/2004; Article 10 (C). Regulation (EC) No. 261/2004 of the European Parliament and of the Council of 11 February 2004 established common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights, and down grading of cabin class. Under Article 10 (C), we are due a 75% refund of the full purchase price of our tickets: A copy of the law is provided as an attachments and can be found at eur-lex.europa.eu/LexUriServ/LexUriServ.do”¦ There is no statute of limitations on this regulation and the law applies to all European carriers regardless of the location of the origin airport so long as some portion of the flight was in the European Union. Condor should be quite familiar with this regulation as they have been successfully sued under it before (e.g. Sturgeon V Condor)
