    Denied boarding

    If a flight is oversold (more passengers hold confirmed reservations than there are seats available), airline personnel must first ask for volunteers who will give up their reservation willingly, in exchange for compensation of the airline’s choosing.

    If passenger is denied boarding involuntarily, he/she is entitled to a payment of ‘‘denied boarding compensation’’ from the airline except in special circumstances.

    On domestic and international flights, passengers denied boarding involuntarily from an oversold flight are entitled to compensation if passenger is offered alternate transport which results in a delay in arrival time as follows:

    0 to 1 hour arrival delay – No compensation.

      1 to 2 hour arrival delay – 200% of one-way fare (but no more than $650).

    Over 2 hours arrival delay – 400% of one-way fare (but no more than $1,300).

    When lengthy delays resulting from denied boarding arise, passengers will be offered accomodationand meal vouchers.

    Lengthy Flight Delays

    An accurate and honest explanation of the delay will be relayed to all Guests in a timely manner and updates will be given every 30 minutes.  Virgin America will make every reasonable effort to accommodate guests with food, beverages, use of the restrooms, and access to medical treatment.

    Flight Cancellation

    For flight cancellations or missed connections for reasons within our control (such as aircraft servicing or maintenance), we will rebook you on the next available Virgin America flight or on another airline’s flight to the same or nearby destination (in which case we will provide you with ground transportation to your originally scheduled airport destination).  If we are unable to confirm you on a flight to your final destination on the same day, we will provide hotel accommodations based on availability and meal vouchers. If the hotel does not provide ground transportation, we will provide a voucher for ground transportation to the hotel.

    For flight cancellations or missed connections for reasons beyond our control (such as inclement weather, natural disaster, etc.), we will rebook you on the next available Virgin America flight. If we are unable to confirm you on a flight to your final destination on the same day, we will direct you to hotels that will offer a discounted rate for guests who wish to purchase accommodations. Virgin America will not provide complimentary hotel accommodations or meal vouchers in this instance

    Lengthy Tarmac Delays at US airports

    U.S. and foreign air carriers do not permit an international flight to remain on the tarmac at a U.S. airport  for more than four hours without allowing passengers to deplane subject to safety,  security, and ATC exceptions.  This applies to small hub and non-hub airports, including diversion airports.

    Notification of the status of delays must be given every 30 minutes while the aircraft is delayed, including reasons for delay, if known.  Drinking water and food will be provided complimentary within the first two hours of a tarmac delay provided the aircraft has left the gate.


    lost bagagge must be reported to a baggage claim officer within four hours of the flights arrival.  Fees for checked baggage will be refunded and a toiletry kit provided to the passenger.  Reasonable purchases becasue of lost luggage will be reimbursed by the airline provided there are receipts.

    Liability for loss, damage or delayed delivery of checked baggage is limited to the actual value of the baggage or $3,400, whichever is less, unless the passenger declares a higher value for loss of baggage, not to exceed $5,000.00

    Passengers should notify the airline of the need for special assistance before their flight. Pre boarding and disembarkation assistance is available.
